SALES AGREEMENT AND CONTRACT

This agreement is made and entered into this ____day of ________ in the

These terms and conditions are entered into and agreed upon by both Seller and Buyer, who acknowledge the moral and legal worth of this contract.

AGREEMENT

In consideration of a purchase price of $_________, the Breeder transfers all
rights, privileges and responsibilities associated with the ownership of the
above described puppy of the Dogo Argentino breed to Buyer with the
following conditions subsequent:

• The full purchase price of said puppy is $__________ for a reproductively intact animal.
• If the puppy is sold as a pet the down payment is $__________ with the balance of $__________ due when the puppy reaches 7 months of age on the _______ day of _________ in the year ________
  This amount of balance will be waived by the breeder if proof of the puppy being spayed or neutered is presented to breeder on or before the date of the puppy reaching 7 months of age.
• It is agreed that this puppy is being sold as a pet:

Ø     Puppies sold as pet-quality, MUST be Spayed/Neutered before 7 months of age.  If not spayed/neutered, the above mentioned balance is due, and registration rights on the puppy will be with-held.

Ø     $100.00  will be refunded once the puppy completes a 7+ week puppy kindergarten or obedience class before 6 months of age.

Ø     $100.00  will be refunded once the puppy passes the AKC Canine Good Citizen test before 14 months of age. Or passes the ATTS Temperament Test before 24 months of age.

Ø     $200.00 will be refunded once the puppy earns any DAAA approved dog sport title before 27 months of age.

Ø     $200.00  will be refunded if a DAAA Versatility Title is earned before the puppy turns 3 years of age

Ø    $100.00 will be refundedif an FSDAA classification is earned before the puppy turns 27 months of age.

GUARANTEES BY BREEDER

Congratulations on the purchase of your new puppy!!  Everything possible has been done to insure that he/she gets the best start possible.  The puppy has been started on its vaccination series, has been checked for internal parasites, BAER tested, and given lots of T.L.C.

1. This Dogo Argentino puppy is FCI (FCPR), AKC (FSS) and UKC registerable and Breeder will furnish the FCPR, AKC and UKC  papers and pedigree (upon spay/neuter proof for pet puppies).  The buyer is responsible for registration fees and submitting the paperwork.

2. FOR SHOW QUALITY ONLY: This Dogo Argentino puppy is show quality as
determined by the FCI standard. If the puppy is determined not to be show quality as it grows up, a refund to pet price will be given after the puppy is spayed/ neutered. If there is a conflict between Breeder and Buyer as to the merit of this puppy, the decision will rest with a mutually agreed upon judge, professional handler, or Dogo breeder. NOTE: We do NOT consider missing teeth, coat ticking, (cropped) ears that will not stand erect, or poor temperament resulting from lack of socialization, to be flaws that would cause a dog not to be show quality. The ears will stand with proper taping, and if the Buyer does not tape the ears properly or socialize this puppy it is not the fault of the Breeder.

3. Since the Dogo Argentino breed is relatively new to the United States, and not enough time has lapsed to correct health problems, there is NO guarantee against genetic health problems including Hip Dysplasia, missing teeth, allergies, or eye problems.  To help prevent CHD, both parents have been X-rayed.  Brillante, her mother and both maternal grandparents all have OFA clear hips.  To help prevent Eye Problems, Brillante, her mother and both maternal grandparents are all CERF clear. 

4.  This puppy has good temperament at the time of sale.  The temperament of this Dogo Argentino puppy will be good as an adult, assuming that the Buyer properly socializes the puppy from this point on.  Dogo Argentinos MUST have proper socialization.  If Buyer does not get this puppy out and socialize it, it could ruin its temperament.

5. If for ANY reason during the lifetime of this puppy if Buyer is unhappy with it or unable to keep it, Breeder will take this puppy back immediately.  Transportation and all related costs are the responsibility of the Buyer. NOTE: IF ANY REFUND IS GIVEN, IT WILL BE MINUS *ALL* BREEDER'S EXPENSES, including but not limited to getting vaccinations up to date, any vet expenses, and advertising to re-home. No dog is EVER sold on a "trial basis" and if a dog is frivolously bought and then returned, the buyer can expect to bear some of the burden of the expense of re-homing the dog.

GUARANTEES BY BUYER

___ 1. This puppy will receive adequate socialization and training to make it
a good pet.  Buyer avows that this animal will become a member of the family, exist as primarily an indoor pet, and receive routine preventative medical care.  This is to assure proper development and maintenance of the temperament, health, happiness, and well being of the animal.

___2.  This dog will never be used for dog or other animal fighting.  If it is found that this dog was used for dog or other animal fighting, the Breeder's reputation will be damaged; liquidated damages of $2000 will be owed immediately to Breeder. Breeder's reasonable attorney fees for recovery of the Dogo or the collection of the liquidated damages will be paid by Buyer. Additionally, rights and ownership of the dog will immediately terminate and revert back to Breeder who may immediately assume possession of the dog

___ 3. This dog is NOT to be sold or given to a research facility, a shelter or humane society, or turned over to a rescue organization, if the Dogo is no longer wanted, Breeder will take the dog back.

___ 4. Buyer agrees to notify Breeder IMMEDIATELY if at any time this Dogo Argentino is lost or stolen, and to make every effort to locate the Dogo Argentino.

___ 5. FOR PET PUPPIES ONLY: This Dogo Argentino puppy is sold as a pet; therefore, it is being placed on limited registration. Buyer should understand that "limited registration" means that the buyer cannot show this puppy in Regular Conformation shows and buyer cannot breed this puppy.   The puppy MUST be spayed/neutered before 7 months of age.  If this puppy is not spayed/neutered by       /       /         , Buyer gives Breeder permission to enter property and remove puppy.  Ownership of puppy will revert back to Breeder.   If this pet-quality dog is bred, the Breeder's reputation will be damaged; liquidated damages of $2000 per puppy produced will be owed immediately to Breeder (regardless of quality or purity of puppy). Breeder's reasonable attorney fees for recovery of the bitch and puppies or the collection of the liquidated damages will be paid by Buyer.

___ 6. FOR SHOW QUALITY BITCHES ONLY, this puppy will not be bred until she reaches at LEAST 20 months of age. She is ONLY to be bred to purebred and registered Dogo Argentinos of quality. Buyer promises to place any pet puppies out of this bitch on limited registration and spay/neuter contracts. No puppies out of this bitch will be sold to pet  stores, puppy mills, commercial breeders, or any type of "resale" operation. If it is found that the bitch was bred before she is 20 months of age, or if puppies from this bitch are found being disposed of through pet stores, puppy mills, commercial breeders or "resale" operations, or if pet puppies are found to be sold on full registration without spay/neuter agreement, the Breeder's reputation will be damaged; liquidated damages of $2000 per puppy will be owed immediately to Breeder. Breeder's reasonable attorney fees for recovery of the bitch and puppies or the collection of the liquidated damages will be paid by Buyer.

___ 7. FOR SHOW QUALITY MALES ONLY: Buyer agrees to only breed this male to registered female Dogo Argentinos of quality who are owned by trustworthy and responsible people. The owners of the bitches must agree to place all pets resulting from litters sired by this dog as limited registration and on spay/neuter contracts. If it is found that his pet puppies have been placed on full registration without spay/neuter agreements, the Breeder's reputation will be damaged; liquidated damages of $2000 per puppy will be owed immediately to Breeder. Breeder's reasonable attorney fees for recovery of the male or the collection of the liquidated damages will be paid by Buyer.

___8. The BUYER acknowledges and agrees that other dominant breeds of dogs may not be compatible living companions for the Dogo Argentino for reasons of dominance, aggression, or sex.  The buyer must give full disclosure to the breeder as to any other dog(s) and pets in his or her ownership or possession at the time of this sale so that its/their compatibility with this dog and/or the adequacy of the buyers facilities for the purposes of ensuring the safety and well-being of this dog can be assessed by the breeder before the final sale takes place, for these are important factors in the breeders decision to sell the dog to the buyer, and the buyer hereby states that (s)he has indeed provided full disclosure of this fact to the breeder, if, after the date of this contract, the breeder discovers as to determining the compatibility of these dogs and may either demand that the buyer fulfill certain requirements that would ensure the safety and well-being of the dog, and the buyer will be responsible for the cost of such, or the breeder may demand the return of the dog from the buyer without any compensation to the buyer

The BUYER acknowledges and agrees that the breeder has fully explained to him/her the naturally occurring dog-aggressive characteristics, the dominant nature of the Dogo, and the possibility for the Dogo to do great harm, and the  buyer fully understands them; that the breeder has stressed the need for, and recommended the undertaking of, proper socialization and professional training of the dogo in this regard, and that the breeder is in no way responsible for or to be held accountable for any future occurrences relating to this Dogos possession of the buyer. 

___10. Buyer agrees that this contract will be bound by the laws of the State of Arizona, and that any dispute regarding this contract will be settled in an Arizona court.
